Terms of Service

These Terms of Service ("Terms") govern your use of the voila application and website (the "Service") operated by Disket France SAS ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of the Service

voila is a messaging aggregator that unifies your WhatsApp and Instagram direct messages into a single inbox. The Service includes AI-powered features that help you compose and manage replies across connected platforms.

The Service requires you to have your own valid accounts on the messaging platforms you wish to connect. voila accesses these platforms through their official Business APIs.

2. Eligibility

You must be at least 16 years old to use the Service. By using voila, you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

3. Account Registration

You create an account using Sign In with Apple. You are responsible for maintaining the security of your account. You may not transfer your account to another person or create multiple accounts. You represent that you are the legitimate owner of any messaging accounts you connect to voila.

4. Connected Messaging Platforms

• By connecting a messaging platform (WhatsApp, Instagram), you authorize voila to access, retrieve, and send messages on your behalf through that platform's official APIs.
• You must comply with each connected platform's own terms of service and acceptable use policies.
• You may disconnect any platform at any time from the app settings.
• We are not responsible for changes to third-party platform APIs, policies, or availability that may affect the Service.

5. AI Features

• voila provides AI-generated reply suggestions and message rewriting to help you respond faster. These are suggestions only.
• You are responsible for reviewing and approving any message before it is sent. We do not guarantee the accuracy, appropriateness, or completeness of AI-generated content.
• AI features use third-party providers. Message content processed by AI is not stored after processing and is not used to train AI models.

6. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk automated messages
• Engage in harassment, hate speech, or illegal activity
• Impersonate another person or entity
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Circumvent security measures or access restrictions
• Violate the terms of service of any connected messaging platform
• Use the Service in any way that could harm, disable, or impair it

We reserve the right to suspend or terminate your account if you violate these rules.

7. Subscriptions and Payments

voila may offer premium features through a paid subscription ("voila Plus"). If you subscribe:

• Subscriptions are billed through Apple's In-App Purchase system and are subject to Apple's terms.
• Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID settings.
• If you are an EU consumer, you have a 14-day cooling-off period for digital services under the Consumer Rights Directive, unless you have expressly consented to begin receiving the service and acknowledged losing this right.

8. Intellectual Property

• The Service, including its design, code, branding, and technology, is owned by Disket France SAS and is protected by intellectual property laws.
• You retain ownership of your message content. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide and improve the Service.
• Content generated by AI features is provided for your use and you may use it freely.

9. Service Availability

We strive to keep voila available at all times but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will give reasonable notice for material changes when possible.

10. Termination

• You may delete your account at any time. Upon deletion, we will remove your data in accordance with our Privacy Policy.
• We may suspend or terminate your account for violations of these Terms, with notice when circumstances permit.
• Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (intellectual property, liability, disputes) will remain in effect.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. In particular:

• We do not warrant that connected messaging platforms will remain available or compatible.
• We do not warrant the accuracy of AI-generated content.
• We are not responsible for message delivery failures caused by third-party platforms.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Disket France SAS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Nothing in these Terms excludes or limits our liability for gross negligence, intentional misconduct, or any liability that cannot be excluded under French or EU law.

13. Indemnification

You agree to indemnify and hold harmless Disket France SAS from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms, including violations of connected platforms' terms of service.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be submitted to the competent courts of Paris, France.

If you are an EU consumer, you retain the benefit of mandatory consumer protection provisions of the law of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
